H&K Prevails, GSG-5s No Longer Produced

You might have heard about Heckler & Koch’s lawsuit against German Sport Guns and American Tactical Imports regarding the GSG-5 .22-caliber carbine...it seems that ATI has lost and Umarex will now be the only company licensed to produce "lookalike" H&K pattern firearms...although they currently only produce H&K airguns they have already contracted with Colt to produce a rimfire M4 copy.

According to industry sources, Umarex has obtained license from H&K to produce HK-416, MP5 and MP7 pattern firearms in .22LR and they should have them on display at SHOW Show in January 2010.

Inc. Civil Action No. 1 : 09-cv-00039-WTL-JMS (S.D. Indiana)

For immediate release,

We are very pleased to report that the litigation filed by Heckler & Koch, Inc. against
German Sport Guns GmbH and its U.S. distributor, American Tactical Imports, Inc.,
together with all counterclaims, has been settled.

The terms of the settlement are confidential to the parties and cannot be disclosed. A
dismissal of the above-referenced litigation, and all of the party’s claims against each
other, is expected to be filed in the near future.

Attorneys for H&K will be issuing a statement. The attorneys for ATI have already
issued a statement announcing the settlement.

Production and importation of the original design GSG-5 ceased as of Oct, 8, 2009 with
the signing of the agreement. The remaining inventory now in the USA can be sold by
ATI, all distributors and dealers. ATI currently has GSG-5’s in stock.

All sales of the GSG-5 by ATI must conclude by January 31, 2010. ATI will continue to
service every firearm that it imports into the USA.

Get 'em while they're hot...I'd suggest picking up at least one of their 1st (Last?) Anniversary GSG-SDs as a safe queen investment gun. Personally, I would not be surprised to see ATI picked as the North American distributer for the Umarex rifles as well...the whole deal seems pretty cosy so I think there was A LOT of cooperative effort as this was settled rather rapidly compared to other trademark infringement suits.

It seems that German Sports Guns was not guilty of producing guns that looked like MP5s after all, they were found guilty of representing the GSG-5 in ads using the trademarked name "MP5"...such as the ATI ad below.

The use of the name "MP5" in relation to the GSG-5 invoked a trademark infringement lawsuit and H&K simply could have buried them in legal fees...they really had no choice but to concede.
